Turbine Turmoil

Some unusual activity has been taking place in Cape Vincent recently.

We just learned that Acciona has sold the St. Lawrence wind project to British Petroleum, and coincidentally Richard Edsall and Marty Mason have both applied for personal wind turbine permits for land that is listed in the BP wind lease disclosures as being under contract with BP wind Energy.
Planning board chair, Richard Edsalls application is for a piece of land on the corner of Burnt Rock Road and Swamp Road with a tax map ID number of 50.00 – 1 – 44.

Marty Mason’s permit application lists a tax map number of 50.00-1-4

The British Petroleum lease easement that I have states:
NO WIND TURBINES.
In no event during the term of this agreement shall owner construct, build, locate, or allow others to construct, build or locate any wind turbines or similar items on the owner’s property.

If personal wind turbines are not permitted on land that is under lease for wind development. Does this mean that Edsall and Mason have not read their contracts or have they lost their turbines?
On the other hand, is there another possible explanation?

At planning Board Chairman Edsalls, last planning board meeting Peter Gross mentioned they were thinking about using larger turbines.
This would mean fewer turbines in the project footprint.
Is it possible that Planning Board Chair Edsall quit in a snit over losing turbines?

Additionally, there were two more permits issued one to Cape Vincent resident Jarvis H Radley with the tax ID number 40.09 – 1– 87

Requirements of Government agencies Cooperation:
Owner shall assist, cooperate with grantee, at no out of pocket expense to Owner in complying with or obtaining any land use permits and approvals

tax- incentive or tax -abatement program approvals, building permits, environmental impact reviews, or any other permits or approvals required for the financing , construction, installation, relocation, replacement, maintenance, operation or removal of Wind power Facilities in the project (whether located on the Property, on adjacent property or elsewhere),

including execution of applications for such permits or approvals if required . In connection with any applications for such approvals, Owner agrees at Grantee’s request to support such application (at no out- of - pocket expense to Owner) at any administrative, judicial or Legislative level. In the event that any laws, rules, regulations or ordinances of any governmental agency provide for setbacks or otherwise restrict the location of any Wind Power facilities to be installed on the property or adjacent properties, Owner shall cooperate with Grantee to evidence waiver of such setbacks.
