Cape Vincent bloggers sued for defamation by wind farm backers

Several longtime residents of Cape Vincent who favor wind farm development have filed a defamation lawsuit against two local bloggers they claim have damaged their reputations by publishing false information about them.
Two of the plaintiffs, Marty T. Mason and Donald J. Mason, contend information published about them cost them seats on the Town Council in last fall’s election.

The state Supreme Court action filed Thursday at the Jefferson County clerk’s office is against Richard C. Wiley Sr., author of a blog at jeffersonleaningleft.blogspot.com, and Kathryn A. Hludzenski, author of pandorasboxofrocks.blogspot.com. Mr. Wiley and Mrs. Hludzenski declined comment on the action Thursday because they had not yet seen it.

When this is settled, if any money remains, it will be returned to identified contributors on a pro rata basis. Any unidentified money will be applied to the legal bills as received before identified monies are used.

Why do so many lawyers fail to give advice these days? Many seem to be willing to do whatever their clients want them to do - such as filing harassing lawsuits that lack any legal merit and assert false damages.

Would it not have been more professional for these lawyers to give some sober advice to their clients - including a little lecture about the special protections afforded to political speech under our constitution and traditions?

Many things have gone downhill in our country. The legal profession is one. Assisting in pointless harassment through the use of the courts is not what good lawyers do.

Good point...What is good for the goose is good for the gander.

If you have read these blogs carefully you know that pro wind make comments too...

What if a court actually let pro-wind find out the names of anonymous they don't like? There are others claiming to be pro- wind who have been making their opinion known about local businesses and especially about a farm lady and a bloggers who they have commented about.

If any US courts flirt with freedom of speech on the internet to that extent of freely exposing commenters like me and you, the counter suits will fly. If the lawyers and their clients get their way it will be mayhem in this town and this country.
