Cape Vincent has had 6 years of PIPing and industrial wind turbines have been rejected again and again by this community


Dear Ms. Brilling,
Tonight, Dec. 6, 2012, BP came to Cape Vincent to explain about  Art. X and the intervenor fund.

Mr. Harris, lawyer from BP,  sat in front of the room and read a long detailed synopsis of  Art. X.   When asked for a copy of it he referred us to the FAQ on the PSC website.

To begin with it is not correct to have an applicant explain how Art. X works.  Mr. Richard Chandler, Project Manger for BP, has already publicly stated that the BP project  "violates local zoning law" (Oct. 23). Therefor an adversarial party is explaining how the system works to its victim.
Do you trust  the wolf to explain to the hens how to guard a hen house?

I would ask the DPS to amend the regulations so that  the PSC or DPS explains Art. X and the Intervenor funds  to communities. (Or help us get back Home Rule!!((:  )


Mr. Harris, lawyer for BP, said the PIP is an ongoing process throughout the whole Art. X process. Since he  represents BP I took the opportunity to ask him several questions about his project.  He also specified that the PIP is a dialogue not a monologue.

1- Will BP produce a map showing the boundaries of the project including participating and  nonparticipating  property lines? This is a normal requirement from any Planning Board and important in order to measure setbacks.
 Mr. Harris, lawyer for BP, said he didnt know if they would nor when they would during the Art. X process.

2- Why do does BP say 200-285 MW?  Why is this so vague? Mr. Harris,. lawyer for BP, said he didnt know.

3- Is any PILOT going to be a 5 way split or a 3 way split? Is the Town of Lyme and the School of Lyme included or not?Mr. Harris, lawyer for BP, said he didnt know.

Since Mr. Richard Chandler, Project Manager for BP, was sitting in the back of the room he was asked to take a turn at the head table and answer these and other questions.
Mr. Chandler, Project Manager for BP,  sat like an o'possum pretending not to be there.

This Public Involvement Program from BP  is clearly a monologue and continues to be evasive.  The PSC is better suited to answer questions about Intervenor funding as Mr. Harris, lawyer for BP, himself indicated.
