Cape Vincent NY Article 10 procedural meeting, Judge Agresta clarifies the question about the Town of Cape Vincent and Payments in lieu of taxes

During last night’s Article 10 procedural meeting concerning the Cape Vincent wind project, Judge Agresta commented about a letter that the Town of Cape Vincent sent to the Public Service Commission November 09 2013, concerning a PILOT agreement for BP’s Cape Vincent Wind project.

The letter stated that any developer that ignores what Cape Vincent wants for its future should expect a fight; it should not expect any PILOT (payment in lieu of taxes), and it should expect that the town will work tirelessly to ensure that other taxing authorities will follow the towns lead.

Agresta noted that it was not within the scope of the Article 10 process to adjudicate whether or not there would be a pilot agreement and that a PILOT was purely between the developer and the town.


 It was further clarified by Jefferson County legislator Michael Docteur that the three taxing jurisdictions, In this case the Thousand Islands school district, the county of Jefferson, and the Town of Cape Vincent had to agree on a PILOT before it could be approved.

Judge Agresta opened Pandora's Box on the issue of PILOTs. He indicated that PILOT payments were outside the Art.10 process, but they proceeded to restate the town's threat to any new buyer that they won't get a PILOT for any project proposal that does not consider the Town's plan and law. Then he asked for clarification on PILOT approvals and Mike Docteur the county legislator responded the town as well as school and county all had the authority to axe an agreement. In other words, all three jurisdictions had to approve in order for any wind developer to be granted a PILOT agreement. This is very important to any prospective buyers.

They want to pay what amounts to 14% of their fair shared of taxes? And they want all county fees to be waived. I pay all my taxes and now my home is less value because of the threat of wind?
Let them be assessed at value and pay their full amount like all of us.

8:22..voters for wind and Acciona tried to change that when the asked the JCIDA to take away the rift to vote by schools, towns and county.

I am sure you meant "right to vote" and that is true.
Some of the very same people signed the petition falsely claiming voter fraud which lead to the illegal resolution. Some of those very same people were plaintiffs in an unsuccessful SLAPP that intimidated and financially accused bloggers and John Does. When Aubertine, Pearson and Wood took their final step falsely alleging, they identified a list. Big mistake? Because that list may very well take counter action. I hope they do and go right for the pocketbook of those who have been making the false claims. Look at the Cape Dem Facebook page and you will see proof of a serious movement to deny others of their right to vote.

If they or their successors have no intention of compliance with the Comprehensive Plan and/or the Zoning Law, then why would they expect to get a PILOT? These blenders in the sky are nothing but a waste of taxpayer money that do absolutely noting for the good of the town or school. PILOT agreements are intended to create real jobs. Few jobs are created by wind power factories. The industry is famous for walking away from their rusting hulks when they become obsolete or when the taxpayers stop the flow of cash to them. Forget the whole mess and never back down to anyone that intends to take over your town, your health, your views, your home values, your friendships, your neighbor relationships, etc. Also, what will you do when (not if but when) they abandon the turbines and leave you to figure out what to do about it and how to pay for it?
