The ACORN Doesn’t Fall Far from the Tree


The discussion, questioning and vote of Paul Aubertine related to BP's wind project and Article 10 that occurred at last Thursday's meeting of the Cape Vincent Town Board once again opens a Pandora's Box regarding conflicts of interest and begs the question, should Paul Aubertine recuse himself from any discussion regarding wind development and BP's Cape Vincent Wind project proposal?. 
Oh, shit!

 
Currently Aubertine resides at his parent's Hell Street property. This same property is part of the farm that is under lease to BP Wind Energy as part of BP's Article 10 Cape Vincent Wind Farm project proposal [parcel 40-1-17, link here to read agreement filed with the Jefferson County Clerk]
 
In 2008 then New York's Attorney General Andrew Cuomo established a Code of Conduct [link] to guide wind developers in New York. The Code states that "The Wind Company shall publicly disclose the full names of any Municipal Officer or his or her relative who has a financial interest in any property identified for wind farm development..." The Code defines a relative as, "...a spouse, domestic partner,child, step-child, sibling, or parent of the Municipal Officer, or a person claimed as a dependent on the Municipal Officer's latest individual state income tax return."  Furthermore, the Code inferred that recusal from any discussion or voting would remove any suggestion of conflict of interest by a municipal official.
 
It is apparent that BP has failed to make the proper notifications and public disclosures that would make them compliant with New York's Code of Conduct for wind developers. Aubertine is a municipal official whose parents have a lease agreement with BP; therefore, BP should have disclosed this potential conflict by notifying the Cape Vincent Town Clerk, publishing a notice in the Watertown Daily Times, posting the disclosure on BP's website and alerting the Attorney General's Office. BP has done nothing to publicly disclose Aubertine's potential for a conflict of interest.

Aubertine's relationship is similar to that of Karen Bourcy, Town of Cape Vincent Planning Board member, who is the parent of a leaseholder [Scott Bourcy, Wood Farms lessor]. She publicly disclosed her potential conflict was identified in a March 2, 2012 disclosure by BP that was posted on its website.[link]
In the past Karen Bourcy has recused herself from discussion and voting on matters pertaining to wind development.

What should happen soon is BP should comply with New York's Code of Conduct and publicly disclose Darrel Aubertine's lease arrangement with BP and Councilman Paul Aubertine's relationship. Furthermore, Paul Aubertine should comply with the precedent set by Karen Bourcy and recuse himself from any discussion or voting on any matter related to industrial wind development.

During the campaign the community gave the kid a chance. He promised moves to heal and understand. He then screwed us over with his Supreme Court action alleging that my vote was a fraud. Thanks Pandora.

A bit off the topic. But I wonder who pays for aubergines water and why is the District 2 situation still hanging over us town taxpayers.
These anti wind jerks tried to prevent the new water district from happening.

Here is a question for Darrell who I know reads the bogs because he has declared how much he hates them.

Mr. Walker has sent a letter to the PSC. The WDT has never followed the process or reported on it.

So Darrell, I ask you, "Where do you think Mr. Walker got his news about PSC progress?"

OK, so Marion Trieste was right. CV is a little Appalachia. OK the Board has a meeting. Six people show up. Little Paul shoots off his mouth. Then they go to the diner and tell whoppers. The hicks from Little Appalachia believe it. Hell, they even tell these same lies in the house of God that has a red sign of hate in view of the front door. Get my drift? What am I going to do about it. I am going to protect my vote from the likes of the Aubertines.

Could Paul Aubertine be so completely out of touch? I wonder if he got dragged into the complaint to deny seasonal voters their right to vote here? I also wonder if he knows that his mom and dad have leases with BP? I wonder if he knows they get checks regularly from BP? I wonder if he knows that his dad is contractually bound to assist BP and their Article 10 application? I wonder if he knows that the town's attorney is paid by BP through intervenor funding? I wonder if he knows BP has quit the Cape and is looking to give away their project? I wonder if he knows BP was funding the SLAPP suits against the Cape's bloggers? I wonder if he knows it's legal for seasonal voters to vote in the Cape if they choose to? Could he be that out of touch?

Dear Pandora's Box of Rocks and readers,
I am a concerned Cape Vincent citizen and life long resident who loves my village and wants my children and friends to love my village. I can take the wind either way.

This ugliness has to stop. Dragging our town through lawsuits and civil rights investigations can be avoided. I have thought about this and talked about it with people who care. I believe a good way to solve this is for Tim White, Darrell Aubertine, Dennis Pearson, Alan Wood and Paul Aubertine, Gary King and Harold Wiley as political leaders to apologize to the Cape Vincent voters and the Jefferson County Board of Elections workers for their actions against people who vote. Those political leaders and the other supporters who have gone on the record are the only ones who can assure the community that the prejudice and hatred they have generated and perpetuated against very good people will stop.
I worry that there is good reason for such civil rights actions, that it is a serious matter and a lot of people will be dragged in. Use the Churches and our clergy to announce a truce on the intimidation and ask the editorial staff of the newspapers to explain what the rules are for New York State voting rights and exemptions.
Then, let's not have another dirty campaign and this time reach for the political truths and strengths of the candidates.

The Aubertine campaign made a big deal about board members behind in their taxes. Aubertine owns nothing and does not pay taxes. Two other candidates are always on the list. Another acorn, another tree.

Every other board member has college experience. All but Brooks has military service. Hirschey was a career man with rank. A CEO. The dems and cfg brought the town a lightweight and a kid who does not even understand the very simple and basic voting rules.

I do not have the specifics on my desk at this moment, but from memory. Several years ago a similar vote was taken in a Nevada case by a town councilman. His case went all the way to the Supreme Court who ruled against him and his vote. In his opinion Antonin Scalia opined that one of the few foundations of democracy and good government was that there was no place in government decision makers on any level for financial conflicts of interest.

I believe you are correct in the challenge of your town councilman and I commend you.

Here we go again. Paul A has as much conflict as Paul Doctuer has. Please explain the difference if you think it is. Paul D. is related to the Woods. Paul A. is related to the Aubertines.
Pandy you must be digging hard to turn the attention away from yours and Clif's unethical behavior.
Here we go about water #2. Why don't you ask Clif, John, Urban and Brooks why it isn't settled yet. I am beginning to think they were all wrong and don't know how to admit they were all wrong.

Hey you turbine cowboy! Here is the difference. Paul Docteur is not in the position of doing bp a favor with a vote. And, if he were as a PB member then Mr. Hirschey has initiated an alternative process which would let Paul step aside. The alternative system was formed wisely. And, I assure you that Paul Docteur is smart enough and honest enough that he would yield to the alternate. But, the PB is no longer the lead agent in bp siting.
So your complaint is moot. A desperate argument.
Besides your desperate personal attack on Clif and Pandy detracts from any legitimate opinion you might have. The ignorance of the turbine cowboys seems to be growing like the green slime in the movie "The Blob" and you turbine cowboys have become the laughing stock of the readers of the WDT and local blogs whose readership and support appears to be growing.
But, more importantly, your vitriol is interfering with any chance Councilman Aubertine has of gaining any respectability.

You name some of the pro wind players and this town can tell stories of wife swapping, wedlock, inappropriate behavior with students, drunkeness, theft of public funds, covering up a crime, DWI, drug busts, fathering illegitimate children, bigotry, intimidation, deprivation of civil rights and living unmarried in sin, etc., etc. etc. Oh, and did I mention wife beating and cheating while on the road?

Let me jump in Turbine Cowboy. But they never made opinions about other people's personal lifestyles. And that's where you turbine cowboys crossed the line. They never sat in bars and behaved the way you turbine cowboys behaved. They never harassed people openly at a bp open house and called them fat and druggie's. They never went into one of your meetings and attacked an old man from behind. The only ethics they are on the record of questioning were those ethics of public servants while they were in office.
Show me one letter to the WDT signed by either Clif or Pandy. Show me one personal attack in the WDT comment section that compares to the disgusting behavior by the Cape Vincent anonymous pro wind comment makers. You turbine cowboys have crossed the line have gone on public record with personal slurs and you will have to live with it because the rest of the world does not act like that. Big difference in criticizing people for public office behavior and personal lives. You turbine cowboys are an embarrassment to Cape Vincent AND AN EMBARASSMENT FOR PAUL AND DARREL AUBERTINE. The map shows that Paul Aubertine is living on Hell Street at Darrel's incestral home and therefore does not pay a cent in property taxes.

Paul, who also mentioned at the last town board meeting how important it was for us to maintain the property tax cap.

Looks like he has got a great idea for keeping his personal tax cap at 0% - just keep feeding off papa and mama's teat by living at home.

I guess it takes a councilman who hasn't paid a cent in property tax to keep the rest of us sinners walking the path to salvation.

Hey Turbine Cowboy. You can help me here since you ware an expert on living in sin. Someone said Paul Aubertine was living in the old Aubertine homestead. You know, in water district 2 where someone might be running a water business possible without the proper business credentials. However, the rumor was the the anti seasonal voter councilman might be living in the village shacking up in sin. Now, I agree with 7:07 that Pandy's personal life is none of your business, but Turbine Cowboy fair is fair and we want to know or maybe your friend escapeturns can help out the readers of the WDT add some insight about the sins of your friends and political allies. Thanks 9:59 for that info. If he lives on the Favret Road, then I guess he might be able to help us out with some questions about water #2. Why did the Ag commissioner get involved? Is anyone selling water? to outside users? Why didn't all those users allow 4th coast to survey the infrastructure? Turbine Cowboy might be the official internet operator for the Aubertines in their community campaign. If news hits the times about #2, then I m sure Cowboy will have something to say on the Aubertine water supply.

For the record the house on Hell st is occupied by Paul Aubertines Grandmother Peggy. Im sure if you looked at public records they would show that Paul Aubertine lives their as well, Paul Aubertine was the current town board members grandfather who is since deceased. Not that many of you are concerned with facts but Councilman Paul Aubertine does not reside there, or is Sackets Harbor for that matter that is another Town Board member.

I want D.A. to run for congress. D.A. has some issues locally that might only be resolved in a campaign. I refer to a Watertown Times article that told that the the then Markets and Ag head was refusing to allow Fourth Coast of Clayton to do a infrastructure survey of his mysterious water district. This district problem is not a new situation and I would hope that a Republican interest group would question that and get to the bottom of that on behalf of any voters who might consider D.A. as an ethical choice to represent us in Congress.

This is what I found:

Is it true that this potential candidate has no education?
