The special Senate election between Will Barclay and Darrel Aubertine brought forth accusations of a conflict of interest for Darrel Aubertine.
February 23, 2008 The Valley news on line reported that on June 4, 2003, Assemblyman Aubertine voted in favor of legislation that would allow farmers to host wind turbines without having their property-tax assessments increased.
Responding to accusations of a conflict of interest in a television interview Aubertine denied voting on any wind power issues “no, not at all, “he said “I never-one way or the other- certainly not for personal gain”.
February 22, 2008 the Syracuse Post Standard reported that their editorial board asked Aubertine if he thought it was appropriate to vote on a measure that affected his own property he responded, “If it was me alone, no” but, he said, “it’s not me, it’s the town and dozens of other landowners.”
A spokesperson for the Aubertine campaign denied any conflict of interest.
“That vote happened over a year before he sold his wind rights,” Aubertine spokesperson Cort Ruddy said, “those towers, if they are ever built, would be owned by the company and would not impact Darrel’s assessment at all. ”Ruddy added that the only approval process is done locally. “The company is going to set up an arrangement with the town for payment-in-lieu of taxes (pilot payments) and there’s usually no assessment,” Ruddy noted.

It is true that the June 4, 2003 vote occurred over a year before Aubertine sold his wind rights however, May, 25 2003 the Watertown Times reported that then Assemblyman Darrel J. Aubertine said a company had approached him about installing wind-powered generators on his property and the properties belonging to three of his neighbors. Aubertine also said the company had been monitoring the wind in the town of Cape Vincent for a year and determined it was ideal for wind development.
New York wind/ Acciona applied for a met tower permit for a parcel on Constance road in May of 2002, over a year before the vote in question. Additionally Aubertines spokesperson deflected the conflict question by responding about assessments and PILOT payments when the bill was about land conversion penalties.
Previously, when land receiving an agricultural assessment was converted to a non-agricultural use, it was subject to a conversion payment equaling five times the taxes paid in the last year in which it received the assessment, plus interest of 6% per year for each year it received the assessment, up to five years.
The bill Aubertine signed eliminated this tax penalty for farmers changing the use of their land from agricultural to non-agricultural.
If Aubertine hosts wind turbines on his land he will directly benefit from this bill.
Aubertines problems did not end with the election, after being elected Aubertine hired his sister to work in his district office, violating the ethics reform legislation he co-sponsored in 2007.
He called it an error in judgment, the ethics reform law he broke called for a 40,000 penalty for this type of “error in judgment.”
Darrel Aubertine had another error in judgment that has plagued him through his political career Darrel Aubertines shameful letter to the Cape Vincent Town Board encouraging board members to vote even though they had conflicts of interest.

The Governor should be embarrassed to allow the Article X thugs to try to take away our local rule.

For many of us 2006 was the year the local wind cabal exposed themselves. The conspiracy to bring wind to Cape Vincent for their personal benefit became a matter of public record. Prior to that the wind industry was out talking to local landowners, making deals and paying contract bribes. For the rest of us we were astonished by their brazen self interest. As the wind cabal moved forward in the following years we began to believe industrial wind was inevitable - many lost hope and despair began to set in. That changed in 2008 when Pandora finally said, "Enough!" Remarkably, it took a quiet, thoughtful, determined woman that first showed the courage to take on Senator Aubertine and the Cape Wind Cabal. Through the years that determination has not subsided, not vented, but persists.
Pandora reminds me of my dog Fred that I had as a youngster who started digging one day in our back yard looking for something, but what? The hole got so big my dad filled it in and tried his damnedest to stop Fred from ruining his lawn. Fred would have none of it and started digging again. This cycle between my dad and Fred went on for quite a while until dad gave in and finally said, "The hell with it let him dig to China." Over the course of the following several months that dog dug for the better part of each day. Our family and friends were enthralled watching Fred dig away wondering what he was after and when he would stop. One day Fred stopped, as abruptly as he began, headed over to the porch and laid down to relax. After that day Fred never dug another hole. We all spent weeks trying to figure out what Fred was after, why was he so persistent? In the end I realized it wasn't important to understand what Fred was after, rather it was important to know we all admired Fred's determination. This event was really important to me and my development as a person because Fred showed me in life you may never accomplish what you hope to; in fact this may be the norm, but one thing we all value in ourselves and others is persistence and determination. I hope in the end Pandora is rewarded for her determination and spirit, but regardless of the outcome for our little town we are all in awe of Pandora and Fred for their herculean efforts. Well done Pandora and continue to dig. Your day to quit and relax on the porch isn't here yet, but it may be getting close. Happy Birthday!

Aubertine's letter has gained the attention of many international blogs as an example of how industrial wind siting disrupts the ethical fabric of a wind targeted community. It has been viewed by every local, state, and federal agency as well as the Attorney General and various courts who have visited my blog.
Three things in the Aubertine letter are common to how industrial wind is able to get a foothold in a targeted community.
1. Conflicts of interest among public officials are of no concern.
2. Guiding principles (codes of ethics) should be ignore or changed to accommodate wind conflicted public officials.
3. Ignore citizens, even if in the majority, when they voice their concerns about what industrial wind will do to them.
Ag commissioner Aubertine served the wind developers that he has leases with very well when he sent that letter to the wind lease conflicted town board.
Because, without those three things industrial wind siting would not stand a chance in any community except for the most barren and and economically destitute.
The town of Cape Vincent is neither.

and the
town had better not be endorsed by the
aubertine-wiley-king political buffoons.
It would be certain political death to their campaign.

When Aubertine got beat because of his unethical wind leases, Andy put him out to pasture like a dried up milk cow. He now feeds from the public trough and shows up to make an occasional announcement like the blight is coming or the turnip is now the state vegetable.
But even in his position as Ag Commish, he should not be taking money from wind developers and helping them stick us with their project.
At Aubertines swearing in ceremony as AG Commissioner, Governor Cuomo, charged Aubertine with the task of picking the state vegetable. Aubertines first choice was a turnip, however due to a conflict of interest he decided to pick corn.
He made claims of being a dairy farmer for years..
The New York Times got caught in a fact check on that one. So did the Watertown Times. But he worse was his lies about wind contracts when he actually had one.
