What is Special about water District #2



  Cape Vincent’s Water District # 2  

Yesterday the Watertown Times reported that several Cape Vincent residents have not been cooperating with Fourth Coast, the company hired by the Town of Cape Vincent to do a physical audit of Water District number 2 .
 Reportedly Agricultural Commissioner Darrel Aubertine is one of the uncooperative residents. Link here to read the story in the Watertown Times

One thing I have noticed in comparing the laws that govern each water district is that not all districts are created equal. It is not what it says in the Rules and Regulations for Districts One, Three, Four, and Five but what is missing from District #2's Rules and Regulations.

From their inception  the Rules and Regulations for Water Districts One, Three, Four and Five have all contained a Penalty clause.  

However, Water District #2 has no such clause. Below is a copy of the clause missing from District
# 2's  water service contract.

Penalties for Offenses
A. The opening of a water hydrant by an unauthorized person or evidence that attempts in the made to bypassing meter or in any manner obtain water from the district without proper payment will result in prosecution under the penal laws of New York State.

B. A violation of these regulations may result in the termination of water service to the violator. All violations of these regulations shall be brought to the attention of the town board for disposition.

C. A person found to be in violation of these regulations shall be guilty of a violation and shall be subject to a fine not to exceed ($250.00) per offense. Each week of continued violation shall constitute a separate offense.

D. Where appropriate the district may seek injunctive relief in a court of competent jurisdiction for enforcement of any provision of these regulations.


Does the fact that this penalty clause is not included in District #2's Rules and Regulations mean that it is acceptable for people in Water District #2 to open a water hydrant , bypass a meter and obtain water in any manner from the district ?

At a recent public hearing a former planning board chair and british petroleum wind lease holder stood up in front of the Town Board. He told the board that he was not comfortable with the camera running because a cape blogger might take it home and use it to tell lies on his blog.

Pro-wind has been been publicly harassing bloggers and claiming they were not telling the truth for years now--at public meetings, while on a the town board and in letters to newspapers.

Cape Vincent will fight to preserve our freedom of speech and the right to vote in Cape Vincent without intimidation from pro-wind citizens.

The blogs were telling the truth!
