Anti-Wind Lawsuits Stacking Up in Ontario


Another group of Ontario landowners has filed a lawsuit against a wind power project in the escalating legal skirmishing over renewable energy. The latest action – against the East Lake St. Clair wind project near Wallaceburg – is the 10th that his firm is working on, according to lawyer Eric Gillespie, who filed the claim.

Like several previous actions by residents living near wind developments, the suit claims damages from not just the wind developer, International Power Canada. It also seeks damages from seven landowners who have leased out their property for turbines.

Gillespie said his clients are seeking a total of $9 million. “The claim is based on alleged devaluation of property,” Gillespie said in an interview. The claimants are asking to be compensated for up to the full value of their properties, he said.

Gilllespie said some studies have shown that property near wind power developments declines in value by up to 40 per cent.

But he said some landowners near wind projects have found no buyers at all when they try to sell, which is why his clients are asking for the full value of their holdings in compensation.

The East Lake St. Clair project is designed to deliver 99 megawatts of power, using about 55 turbines.

Luckily for Cape Vincent and Lyme Bp's voter for wind group has for years been making the claim that home values WILL NOT BE impacted by their industrial wind. It now appears that the future lawsuits will be based on incredible documentation to the contrary thanks to the people who spoke out on the blogs.

Hopefully, at some point those who have publicly made false claims about erroneous impacts on land values will be asked to account for those losses.

Another blogger for the welfare defense fun. The money is their for BP. If they get going and get more favorable publicly from the state the gov't will extent the money for BP to build their turbines in the Cape and Lyme, the 96% will eat their words that are against turbines.You may have won some battles, but you didn't win the war yet.I'll get my dam money someday, it'll be worth the wait.

Very good point. I have studied the A-10. I see nothing in there that exempts the leaseholders and other voter for wind from legal action when it is proven that neighbor land values are decimated. Will Bp protect them against that? I wonder. Such action is growing fast in other wind towns. At what point does Bp throw the leaseholders under the bus? Leaseholders had better get some protections in writing.

The only land that is decimated are the land owners that are against wind turbines. Sorry about that. If you complain they will come, so keep complaining. Good bye.
