CAPE VINCENT — Town officials got together Thursday afternoon to identify issues that need to be addressed during the state Article X siting process for the proposed Cape Vincent Wind Farm.
Town Councilman Clifford P. Schneider said developer BP Wind Energy, in its correspondence with the town government, talks about its proposed project almost as if a wind farm in Cape Vincent is “inevitable.”
“This is not a done deal,” Mr. Schneider said. “And it’s not inevitable.”

The following comments on BP's DEIS represent DEC's concerns for the proposed Cape
wind power project specifically and for cumulative impacts on the region from all proposed wind power projects in the general area.

DEC’s review of the DEIS has found serious deficiencies in
terms of the proposed project scope, location of proposed project components,
characterization of natural resources in the project development area,
assessment of potential environmental impacts, and discussion of mitigation
options. Additionally, the intention to defer, completion of the proposed
project layout, basic resource studies and other developmental plans until the
final environmental impact statement (FEIS), or later, limits meaningful review
and comment on the proposed action by involved agencies and the public, it does
not allow for a full public discussion of reasonable alternatives review of the
DEIS shows that at least 21 plans, studies or reports necessary to adequately
assess the potential environmental impacts of the project have been deferred to
the FEIS or later. Several of these are important for DEC's consideration of
permit applications that are anticipated to be required for construction of the
project. These include a detailed map of the turbine array and
projects components, turbine specifications, wetland delineations,
transportation study and routing plan, final visual analysis, archaeology and
architectural surveys, Indiana bat survey, Blandings turtle trapping study,
storm water and erosion control plans, including a survey of karst features,
and it environmental monitoring plan. Further, the DEIS does not anticipate
that a number of items recommended by the DEC in comments on the draft public
scoping document will be discussed even in the FEIS, including source location(s)
for aggregate materials, environmental restoration plan, and operations and
maintenance plan, a compensatory wetland
mitigation plan, and invasive species control plan, or a plan for offsets to
impacts to visual and historic
resources.
DEC strongly recommends that a supplemental DEIS (SDEIS) be
prepared to include more complete data pertaining to these resources, in order
that involved agencies and the public have the opportunity to comment on
potential impacts to these resources. As an involved agency under the state
environmental quality review (SEQR),DEC must make findings based on the record
in the FEIS prior to approval of any agency permits that may be required for
project construction. A complete EIS record is critical to the DC, and without
it the department will have a limited ability to make the required findings as
an involved agency.
DEC provided comments on the DEIS Draft Scoping Document,
dated August 13, 2007 in a letter to the planning board dated September 14,
2007. The draft scoping document proposed the EIS process " will take
place in two phases. In the first phase, wider core doors of potential impact
throughout the project will be studied" and" will be presented in the
draft EIS." Then, following a" more detailed turbine plan which will
specify the final placement of turbans, roads, a substation, electrical
interconnects, transmission line, and a permanent maintenance facility… A
revised draft EIS will be prepared…" (draft scoping document, page 2). In comments on
the draft scoping document, DEC stated that," SEQR regulations at 617.9(a)(7)
provided existing process for the lead agency to require a supplemental EIS,
subject to the full set of procedural requirements for the DEIS" in order
to ensure that all phases of the DEIS process allow for ample review by
involved agencies and the public,DEC further recommended that"… A formal
scoping process be conducted again prior to preparation of a SDEIS, in order
that the full range of issues of concern to involved and interested parties can
be addressed." DEC is disappointed that the final public scoping document,
dated October 8, 2007, fails to include the “revised" DEIS, and defaults to a
schedule that defers a full discussion of project details and potential impacts
to the FEIS.

Instead of wasting their time and money suing the bloggers VFW should have set up a defense fund in case suits get filed against their public official buddies who were apparently not serving in the citizen's best interest.

A very important quote from the Times:
"But Cape Vincent officials said Thursday that because several town officials at that time had financial conflicts, some of the record went missing and valid concerns from the town engineer were ignored in some cases."
All of this is documented damage done by what many perceive as government corruption.
Any actions that were taken by the previous planning board should be challenged and scrutinized as they seem to be doing.

More claims of outsiders running the Cape.
Cape Vincent, as well as other Lake Ontario and St. Lawrence communities, make up 40% of the Jefferson County Tax base.
Cape Vincent as well as other Lake Ontario Communities has twice the number of seasonal residents as those who claim to live there during the winter.
More than 60% of the Cape Vincent taxes are paid by those who leave for part of the year to another residence.
To vote at a residence of their choice a US citizen has to live there 30 days.
Voting in Cape Vincent, as well as other communities, is a legal choice. In Cape Vincent, that choice has been made by pro-wind who are seasonal as well as anti-wind who are seasonal.
Majority still rules and the elections in Cape Vincent have been certified and pro-wind officials who had leases with wind developers have either lost their elections or resigned their positions.
The turbine cowboys lost the election. Get over it!!!!
Great idea to dig up all the old agency reviews that conflicted Edsall and his board ignored and stick them right down BP's pie hole. Whole different situation when town officials aren't getting paid by BP.

Its all a bunch of bluster. BP won't be frightened or deterred,as long as they have Cuomo and his energy goons in their pocket. ART. X is their gravy train. The Cape zoning law, Comp. Plan, and previous studies or lack of studies, surveys, etc. have all been left behind on the tracks.
Its Cuomo's train, he owns the engineer, BP has paid for its ride,they fully expect to get to their destination.

You have set the example. TPB members are supposed to be working for the people and not against them to serve their own self interest and ranting around. CV was getting fed up with the actions of the past chair (Mr. Edsall) who you said did not leave any records.
Lets put MacSherry in charge of this whole affair. He's the only guy on any of the boards who seems willing to kick BP right out of town and defend the zoning law to the hilt.
Seems like the other seven members of this committee are willing to negotiate with BP and the State over specifics. Bad policy!!

I doubt Andrew Cuomo gives a shit about how poorly the SEQRA reviews were handled in Cape Vincent. There's a new energy sheriff in Albany and he wants turbines up in the Cape. Only legal action will stop him.

You think that this area is a welfare state when their homes are located on the river in the choice places. When they build those turbines your property will be worth half as much, good luck selling. That's why I will not donate to the bloggers welfare fund. Living on the Black rivers banks is a far cry to the St Lawrence river. We still have the best fishing and hunting in the north county, not like you idiots in the Cape and Lyme. My taxes are even cheaper for waterfront property then your paying. The best part is we aren't fighting with each other over wind turbines. You guys are the laughing stock of the state and you will not win the battle. The gov. will have the last say what is build or not build. No flicker, no sound effects, no blinking lights, a quiet nights sleep every night. You are confused about the definition of welfare. Welfare is when the government takes money away from all of the taxpayers and puts it into the pockets of people and businesses that can't make it on their own.
Like leaseholders and Bp for example who can't do wind without 60% subsidy.
The bloggers fund is a voluntary contribution by hundreds of people who defend freedom of speech and home rule. Citizens who speak out against bad government and shoddy business in an effort to protect their rights, defend against false charges and prepare future legal counters against those who subvert our freedoms.

Did anyone do a video of the meeting. I heard that a lot of problems of the
Edsall years planning board were divulged. He signed leases with Bee Pee
Kiss my ass to your welfare defense fund. You'll need every penny if you expect to beat BP at its game. I'll sit back and enjoy the peace and quiet of a good nights sleep.
So, you are confirming what most everyone believes that Bp is behind this lawsuit and the purpose is to scare the hell out of people and take their money? I think they should spend their money on defending future lawsuits that might be launched against the pro wind and corrupt former officials who done us wrong.
