AG launches an investigation into Cape Vincent wind dealings

The state Attorney General’s office has launched an investigation into possible misconduct by Cape Vincent officials for wind turbine farms proposed by Acciona Energia and British Petroleum.
In an Aug, 13 letter, the state ordered all documents from the town council and planning board related to wind development be turned over.
Two out of five town board members and three out of five planning board members either personally have agreements to lease their land to wind developers or have relatives with wind leases.
One current state senator is also reported to have a contract with a wind developer.
The Watertown Times recently reported that, “State Sen. Darrel Aubertine receives more than a $1,000 annually from a Cape Vincent wind developer even though his spokesman said there are no plans to build a turbine on his property.”
As reported in the Feb. 23, 2008 issue of The Valley News, Aubertine’s disclosure statement, filed May 15, 2007 with the state Legislative Ethics Commission, does not list any interests or contracts with any wind-power companies.
His disclosure statements show he and his wife Margaret own a total of just more than 600 acres of land.
His most recent filing does show income from a St. Lawrence County wind farm.
Oswego County officials have been closely observing all that is happening with wind farms in the north country, as one proposed project would site the high-powered transmission lines somewhere within the county boundaries.
One proposed route for the Galloo Island project would bring the lines through the Village of Pulaski, a plan that county lawmakers oppose because the county coffer relies on the fishing industry that could be substantially impacted.
The original path of the line was to run from Henderson to Ellisburg, Sandy Creek and Pulaski to a National Grid line in Mexico.
A change in the route had the lines running into Hounsfield and along Route 12F to an electric substation on Outer Coffeen Street in Watertown.
The most recent proposal is actually four proposals and public meetings are scheduled for each potentially impacted municipality.
The prospect of wind farms has sharply divided communities and opponents of the two proposed wind farms at Cape Vincent reportedly brought the investigation to fruition. The opponents complained that the process was tainted by conflicts of interest on the town board and planning board.
There is civil unrest in Cape Vincent,” Legislator Shawn Doyle said. “When you have over 200 people going to a meeting within a town divided, something’s going to break.”
Doyle and former U.S. Ambassador and State Senator H. Douglas Barclay represent the county in wind matters. Doyle has attended dozens of meetings in the past two years in Oswego, Jefferson and St. Lawrence counties.
Aubertine spokesperson Drew Mangione said last week that the senator cannot comment on the current investigation.
It is not known when the investigation will conclude.

Marv and Marlys Jensen just wanted to supplement their income with a little energy-and-money-producing wind turbine on their farm in rural Kensington, Minn.
But they ended up taking out loans to pay more than $245,000 to an Excelsior-based company called Renewable Energy SD for a 160-foot wind tower that currently produces nothing.

People of Cape Vincent have had enough

If you’ve been wondering who has “had enough yet” in Cape Vincent, just ask around. How about the residents on Burnt Rock Road who have been hearing for years about studies to be done and research completed on a water district for their street?
Meanwhile, motions were passed, studies conducted, contracts issued for surveys, only to then be determined it was all done improperly, therefore more studies, motions repassed and more surveys conducted on a water district for Tibbits Point Road. In the past two years, tens of thousands of dollars were spent in an effort to get water to three town board members’ properties. Sorry, residents on Burnt Rock Road, no member of the board lives on your street so don’t expect water in the near future. Had enough yet?

BP's Outreach “It’s all - it's all about the messenger, right.”

 Recently, I received copy of the latest Cape Vincent Wind Farm news letter . It came in an envelope with a return address of Trieste Associates Inc.

Marion Trieste President of Trieste Associates works for top tier industrial wind companies such as BP and typically she is brought in to industrial wind targeted communities where the proposed development has become controversial.  Trieste has a formula she calls “Grassroots organization”
 In a Webinair promoted by the Department of Energy Titled Community Acceptance of Wind , Marion describes her "Grassroots" formula for making a project work for the developer.

    Trieste tells developers
We really have to invest in the public”. “You’re only going to increase your odds of success if you're investing in our host communities.”

In 2008 British Petroleum hired Trieste to do "outreach work” and this is when and why she established Voters for Wind (VFW).

Trieste talks about her favorite group Voters for Wind, saying,
They actually established themselves two years ago.
 “And I worked with them with a BP wind power project here.” “BP was - is the developer that I'm - I've been working with here.”
It’s all - it's all about the messenger, right.”
 These groups work well because the developer may be seen as having other goals in mind such as profit.

Trieste Creates a pro - wind coalition or network by holding small private gatherings with landowners, that are not open to the public, arming landowners with generic information about the development process, crafted to debunk the myths about Property values. Birds, Sound etc.
At these gatherings they formulate their mission to go out and "educate" people and encourage them to show their support for the proposed wind development.

They promote the notion that they have altruistic motives in their desire to push a developers project and not because they are gaining financially from it;

It just warms my heart to watch what's - what evolves with connecting people to each other in a community.”

Trieste tells the developers, to distance themselves, so they don’t taint the process, people may think they are being used by the wind developers.

At GEOS we call ourselves like a little buffer between the wind farm developer who's our client and those on the ground who are basically those most impacted in the local communities.”
So we can do a lot more good out there if we are seen as independent and are and acting as independent individual grassroots organizations.”

Additionally Trieste stressed the importance of the economics of wind. 
Money is a method used to promote the project as well. “Money talks” this is where the host benefit packages come into play as she characterized our area as little Appalachia.

Trieste used the webinar as an opportunity to engage in exploitation of community division describing the typical industrial wind opponents, as wealthy short term summer residents, retired Wall Street attorney types from New Jersey and New York City that do not care about the community, jobs or taxes. 
They just care about their view-shed”

In contrast to the characterization of the Anti- wind Trieste describes the pro wind, as the downtrodden silent majority, farmers struggling to survive .  People who are invested in the community and have been invested in the land for generations and now their grand kids are never going to be able to live here because 

there’s nothing for them . They get it.”

Additionally, Trieste would like to educate our children about industrial wind as well.

I can't emphasize enough that we need to be more and more in our schools. to get young people involved, Let's go and let's shame the older generation into doing this.”

Remember to Vote 10 September 2013 Republican Primary 


I am writing to request your vote for Town Council in the forthcoming Republican Primary election . I have been privleged to serve the community as a town Board member since January 1, 2010. I maintain that I have served ethically and compentently . I believe that there is much to do in the community and I am seeking a second 4 year  term. I am a lifelong resident of Cape Vincent and have a deep love for the esthetics of nature and the history of Cape Vincent . My family roots go back to my great-grandfather Elon R. Brown who was NYS Senator from this area and a leader of the Senate in Albany. If reelected I shall seek to promote the scenic and historic preservation assets of the communityy . I have a real estate company known as Johnston Development Corp and I shall continue through it contribute to the taxable assessment base of Town . I am currently a NYS liscensed real estate agent with Hefferon Real Estate. I graduated in 1968 with a degree with honors in the History of Art from Williams College. I feel that I understand the Town's finances and I have reported monthly at Board meetings on the balances in the Town's accounts. I shall continue to support the development of the Cape Vincent economy and look forward to the Town building on the establishment of Metal Craft Marine. I have made sincere efforts to see that wind turbine development is done right , with propper checks and balances and within the directions of the Cape Vincent Zoning Law,and I shall continue to do so. I sincerely request your vote on 10 September 2013, and promis if elected to serve the common good of the community as best as I understand it.

BP's proposed Cape Vincent wind project has the potential to adversly impact ...

Chances are, buying a home is the biggest purchase we'll ever make.

 BP's proposed  Cape Vincent wind project has the potential to adversely impact property values in our community.

As a result, the Town of Cape Vincent and WPEG applied for and were allocated 15,940,  by the Public Service Commission , to retain the services of  Michael S. McCann, a real estate appraiser. 
McCann will assist with land use and property value issues for the Article 10 process.


 Michael McCann , evaluated  Cape Vincent's economic report in 2011. 
After completing his review  of the subject location,   McCann reported that it was clear that numerous homes in the Cape Vincent area will be adversely impacted, and the best available evidence indicates that value loss of 25% to 40% or more will occur to homes within approximately 2 miles of the turbines. This impact is not expected to be uniform, and some losses may well be lower and others higher.

Economic Impact – Final Report October 7, 2010 (EIR)

Dear Committee Members:
As requested, I am submitting this real estate review of the EIR undertaken by the appointed Cape Vincent Wind Turbine Economic Impact Committee (Committee), for consideration and use by Town planning and zoning officials in addressing the compliance of the proposed wind energy projects in the Cape Vincent area with typical zoning and land use requirements that must be met for approval of the Project(s).

As this review is focused on the Committee’s EIR, McCann Appraisal, LLC (McCann) has not made specific reference to the applicable codes, ordinances or regulations. However, my review recognizes that special permits or special use zoning approval for a variety of land uses, including large-scale wind energy turbine projects, require that the proposed use will not have an adverse effect on the market value, use, enjoyment or development potential of other property in the neighborhood or surrounding area.

Also applicable from a real estate, land use and zoning perspective is my review of the Hessler Associates, Inc. Noise Impact Assessment report issued April 13, 2010. (HAI report). The McCann review of the HAI report is not undertaken as a technical acoustic engineering evaluation but, rather, to the extent that it overlaps with real estate issues. More specifically, the question from a real estate perspective is whether or not the HAI noise study demonstrates that the quality of life, peaceful use and enjoyment, aesthetics and overall marketability of residential and related property will be adversely impacted as a result of the wind project(s).

Professional Opinions My professional opinions are effective as of the current date. My review of the Cape Vincent EIR and this Consulting Report have been prepared and submitted pursuant to applicable licensing laws that mandate compliance with the Uniform Standards of Professional Appraisal Practice (USPAP), and my opinions are certified accordingly.

Briefly stated, based upon my review of the Committee EIR, as well as the location of the proposed facilities, the density, height, type and intensity of the proposed utility scale turbines, along with my independent and ongoing research of real estate and property value impacts near turbines. The EIR is correct in identifying significant value loss potential as a result of the two wind turbine projects proposed , or as a single project. While estimates were made in the EIR based upon 1,000 to 3,000 foot setbacks, there are numerous examples of value losses at even greater distances; some in excess of three miles.

Guest Voice: Don't believe claims about wind power

Matt Walker made many claims about problems caused by fracking and the benefits he believes are inherent with "renewables," in his Aug. 12 Guest Voice column, "Erie should focus on clean energy."

While it is true that there are problems that come along with the development of any energy source, wind is no exception. And while it may come as a surprise to those in the alarmist camps, the fact is that there is a direct correlation between improved health and longevity in the United States, and the availability of reliable, affordable power here (ie: coal, natural gas, nuclear and hydro).

Let's consider the results to date of the billions of dollars that taxpayers and ratepayers have been forced to fork over to the wind power sector that Walker favors. Continue... GoErie

Decline of renewables

Many today believe that renewable energy will let us get off fossil fuels soon. Unfortunately, the facts say otherwise. According to International Energy Agency data, 13.12 percent of the world’s energy came from renewables in 1971, the first year that the IEA reported global statistics.

 In 2011, renewables’ share was actually lower, at 12.99 percent. Yet a new survey shows that Americans believe that the share of renewables in 2035 will be 30.2 percent. In reality, it will likely be 14.5 percent.

Wind farms study will be published

A study examining the impact of wind farms on the countryside will be published, the Environment Secretary has pledged.
Owen Paterson said that work is ongoing on an official study that officials at the Department of Energy and Climate Change (DECC) have attempted to block.
Coalition sources have said that officials in the Department of Energy and Climate Change (DECC) – run by Ed Davey, a Liberal Democrat – have attempted to stop the report being written over fears that it could provide confirmation that turbines can harm rural areas.
Mr Paterson has made clear that he intends to make the document public as soon as it is ready. Continue... The Telegraph

State impliments a registration process for STAR exemptions.

 The state Department of Taxation and Finance is implementing a new registration process requiring homeowners currently receiving Star property tax exemptions to register with the state was instituted to eliminate fraudulent duplicate registrations.

Senior citizens receiving enhanced star exemptions will not be affected by this change. That program already requires annual registration. Continue...

This new state registration process should ease the minds of a local organization Citizens for fair Government (CFG).
The CFG has also been involved in preventing "fraudulent star exemptions." They have undertaken numerous measures to safeguard the civil liberties and interests of year-round residents of the Town of Cape Vincent.
 One example of this took place August of 2011 when a member of the CFG Presented a petition to the Town of Cape Vincent Town Board asking the board to take action to prevent what they called voter fraud. Subsequently the Town Board passed an illegal law requiring selective voter Identification.

DANC, Cape Vincent town officials upset with BP Wind

CAPE VINCENT — BP Wind Energy and stakeholders of the developer’s proposed Cape Vincent Wind Project — the town government and the Development Authority of the North Country — again are at odds over the definition of a “meaningful dialogue.”
In a recent letter to BP, the attorney for DANC urged the wind developer to provide additional information to the development authority’s engineers — a request made four months ago.

Turbine goes up in flames

Black smoke was highly visible between Trent and Sweetwater Monday as a wind turbine at the Trent Wind Farm caught fire.
Sweetwater Fire Chief Grant Madden said crews from his department and from the Trent Volunteer Fire Department were sent to the location just south of Interstate 20 and east of Lake Sweetwater at 10 a.m.
“There was no need for us to go up in the turbine so we didn’t,” Madden said. “We stayed well enough away and controlled the grass fires from the falling embers and fiberglass.

Inmates in Brazil's Santa Rita do Sapucai prison can now put the pedal to the

metal to shorten their time behind bars.

The city’s judge has instated a policy that rewards prisoners for generating 

energy by riding stationery bikes, according to a report in the Jornal Nacional.

Prisoners can knock a day off their sentences for every 16 hours they pedal.

If the powers that be (government agencies, Department of Environmental Protection, Board of Health, etc.) really wanted to know how people felt about industrial wind turbines (IWTs), don’t you think they should ask the people who are most impacted by them? Like the folks who areforced to live under these ungodly monsters?
Don’t you think if they really wanted to know what the effects are from living too close to IWTs that they would fund some research or get the information first hand? Like -- I’ll say this one more time -- from the people who are forced to live under them?

Supervisors to vote on a resolution asking the state to fund a study on the impact of wind turbines on human health.

Residents to voice turbine impact stories

It has been approximately 20 weeks since the blades on the Canadian Auto Workers’ (CAW) wind turbine in Port Elgin have been spinning. It has also been the same amount of time since members of Stop Turbine Operation Policy (STOP) have been tracking complaints of those experiencing alleged negative impacts associated to the turbine.
A recent email sent to those on STOP’s mailing list, provided some of those complaints which included audible noise outside the home preventing property enjoyment; inside the home causing sleep depravation, headaches, nose bleeds, nausea and dizziness, to name some. In the same email, STOP spokesperson Greg Schmalz said the listed symptoms go away when those affected leave the turbine area, but reappear when they come back.

Man pleads in Noxen shooting

The Tunkhannock man who fired a gun at a carload of people in Wyoming County faces a maximum sentence of 28 years in state prison and a $45,000 fine for his actions.

Wade Douglas Wright, 43, Copper Kettle Park, pleaded guilty to four counts of reckless endangerment and one of aggravated assault when a bullet from the gun Mr. Wright fired Aug. 12, 2012, struck passenger Mary Josephine McClaine of Clifford. Group joins fight against Wind Turbine eagle-kill allowance

PAWHUSKA - The National Congress of American Indians has joined the Osage Nation in opposing federal actions to permit eagle kills caused by wind industry development on tribal lands without regard for tribal cultural interests and authority. 

A resent National Congress of American Indians resolution says authorizing the wind energy project to kill eagles in Osage Nation territory without the tribe's consent would set a dangerous precedent. Police called to Cape Vincent Town Council Meeting

   Cape Vincent has a large seasonal population , the seasonal residents do not live here year round, consequently they are not able to attend many Town Board and Planning Board meetings .
  In an attempt to inform people about what was happening in our community concerning two wind developments proposed for Cape Vincent I began blogging.
Around that same time Cape Vincent resident John Byrne began taping portions of the Town Board and Planning board meetings to allow people to see what was happening in their community.
By August of 2009,  the two gigantic wind development proposed for Cape Vincent were becoming extremely contentious.
At some point I discovered John Byrnes videos on YouTube , and I began posting them on  my blog. 
Supervisor Reinbeck assumed that my blog belonged to John Byrne and he had objections to the videos and the information that was being posted with them.  

As a result Reinbeck decided to take action to stop the videotaping, during the Town Board meeting of August 13,2009 Rienbeck tried to use the police as an intimidation tactic to force John Byrne to remove his camera from the Board meeting. 

 At the end of this post are two YouTube videos one is of the above mentioned of this meeting, as well as a video of the Planning Board meeting 8/12/09 where the Planning Board  also objected to Mr. Byrns video taping

 CAPE VINCENT, N.Y. -- The Cape Vincent town meetings have been getting pretty heated lately. Last week the police were even called.

Town officials' issue is with John Byrne who has been recording the meetings for more than a year. Their biggest concern is that the video is being taken out of context and used on blogs as an attack tactic.

"They're only showing one portion of the videos, which everything you've seen, when you see the blowups, they've only been of them. They have not been any videos of the rest of the audience. No video of how maybe the planning board or town board member got upset to begin," said Thomas Rienbeck, Cape Vincent Town Supervisor.

But legal experts say there's nothing wrong with only posting portions.

"The courts have said that once somebody records a meeting, the fact that it may be edited or altered or even used out of context is beyond anybodies control. It's perfectly valid," said Robert Freeman, NYS Committee on Open Government Executive Director.

Byrne says he's only been posting portions of the meeting because of logistical and time constraints.

"To post a whole meeting would take an enormous amount of time. YouTube allows you to only post approximately 10 minutes at a time, so I try to grab 10 minutes of every meeting that the residents seem to be the most interested in," said John Byrne, Cape Vincent resident.

Town officials are concerned about what will happen at future meetings.

"Where do you draw the line on this saying this is being abusive and disrupting meetings. But they're not coming out and saying that. How far do you go before you say this is enough?" said Rienbeck.

But both town officials and Byrne say they're not going anywhere.

"I will continue to record the meetings. It's a constitutional right. I feel it should be exercised. If they did it, then the citizens wouldn't have to," said Byrne.

And town officials say they're looking into just that.

Town officials say they're also looking into changing the structure of their meetings to prevent further outbursts and arguments.

Utility officials fined on freebies

National Grid mistakenly thought it was OK to take state regulators on golf outings, and a few of the public officials mistakenly thought it was all right to accept the freebies.

People of the Gulf South are united by a sense of fundamental fairness; they live by the creed that your word is your bond. If you make an agreement, you live with the results. Oil giant and convicted corporate criminal BP, however, does not live by the same creed. BP is waging a nasty, untruthful campaign to renege on its agreement to the people of the Gulf Coast and rewrite the settlement agreement it negotiated after causing the deadly Deepwater Horizon oil spill.

A coalition of lawyers representing victims of the BP oil spill has launched a website that tells the truth about BP and its despicable campaign of innuendo and gossip.  The site, www.bpfraud.com, uses court documents and news coverage to show that BP's ridiculous claims of fraud are nothing more than a cynical attempt to once again wriggle out of its court-ordered obligations.

BPFraud.com poses a simple question to the people of the Gulf Coast: Has BP made you whole yet? If not, why? BPFraud.com asks people to share their stories to counter the lies told by BP's massive legal, public relations and political lobbying campaign. Likewise, we're asking BP workers with a conscience to follow their own company's advice and report anonymously any and all behavior that demonstrates BP's deceit. We will investigate those claims and hold BP accountable for its reprehensible behavior.

Andry Lerner has willingly cooperated in the ongoing investigation by Judge Louis Freeh who was appointed by U.S. District Judge Carl Barbier to investigate the Gulf Coast settlement process. Andry Lerner is confident that Judge Louis Freeh will find no wrongdoing by the law firm and will conclude that the overall claims process is administered professionally and conscientiously.  In the meantime, we want the world to know the facts:
  • BP is a massive multinational company found guilty of criminal conduct that killed 11 people and financially devastated many thousands more. While BP reaps profits of about $20 million every day, it is paying hundreds of thousands of dollars an hour to lawyers and consultants in an attempt to break its agreements and short-change people of the Gulf Coast who are struggling to pay mortgages and keep small businesses open.   
  • BP spent two years negotiating a settlement agreement that eliminates what would have been years and years of civil litigation. BP underestimated the cost of the settlement damages, and now is attempting to rewrite the deal. BP negotiated and approved the very process it now calls corrupt. Indeed, it actually requested and approved Mr. Pat Juneau as the Claims Administrator.
  • BP is paying its lawyers. BP is paying its lobbyists. BP is paying its spin-doctors. The only people BP doesn't want to pay are the people whose lives it up-ended with its criminal behavior.
  • BP is enlisting the media to offensively portray the people of the Gulf Coast as opportunists filing fictitious claims. The reality is that, under the settlement agreement reached by BP, claims either meet the proper criteria or they don't.  BP cannot now dispute claims that are considered legitimate under its own settlement agreement.
  • BP employs scores of lawyers trying to wriggle out of its obligations, but casts aspersions on the attorneys helping small businesses such as shrimpers and hotel owners receive their rightful monetary awards.
  • BP claims there are large numbers of fictitious claims, yet it has not documented a single one.  Fortunately, Judge Barbier has seen through BP's smokescreen and has ordered that claims continue to be paid. If, in fact, there are fictitious claims, we expect that they will be denied.
  • The unproven specter of fictitious claims, though, is no reason to abolish a program that has helped people put their lives back together. Even a small number of fraudulent claims – inexcusable as they are – does not justify BP's contemptuous response. If BP's argument were applied to itself, the company's own criminal behavior in the Deepwater Horizon catastrophe alone justifies shutting the British oil giant down.

We are committed to opposing BP's stubborn and ongoing efforts to block payments to its victims. We will fight BP in the court of law and we will fight BP in the court of public opinion. We will fight with facts, starting with an expose of BP's abuse of the legal system with baseless accusations and frivolous filings that serve only to clog the very courts that are holding BP accountable.

First Wind willing to trash Maine

First Wind of Boston is now proposing a project for the western mountains — the largest industrial wind project to date.
It would stretch more than 25 miles from Bingham to Parkman. CPS Energy doesn’t anticipate buying power from new federal wind farm

CPS Energy, San Antonio’s city-owned utility, has no immediate plans to buy power from the federal government’s largest wind farm, now under development in the Texas Panhandle.
Siemens Government Technologies Inc. this week broke ground on the farm near Amarillo for the National Nuclear Security Administration. The operation will generate 47 million kilowatt-hours of electricity annually.

Green energy costs raising concerns

Mandates account for 5.4% of monthly bill

THE RISING COST of green energy mandates in Massachusetts is starting to raise concerns, with one utility estimating the state's renewable energy initiatives currently account for 5.4 percent of a typical customer's monthly bill and are expected to take a much larger share in the next few years.
National Grid, in response to a request from CommonWealth, estimated its typical electricity customer is currently paying $3.95 a month to support the state's primary renewable energy initiative, a cost that is expected to rise another dollar a month by 2015. Grid officials said a secondary subsidy for renewable energy development, called net metering, currently costs ratepayers 9 cents a month, but is forecast to rise to 23 cents a month by the end of the year and to 93 cents a month by 2015. Transmission ruling sets off alarms in clean energy industry

A federal judge’s decision this week that New England electric transmission companies should make less money on power line projects has triggered concern among wind and solar generators hoping to see a revitalization and expansion of the country’s aging grid.
Administrative Law Judge Michael Cianci Jr. issued an initial decision that would reduce the return of transmission owners’ investments from 11.14 percent to 9.7 percent in New England states like Connecticut, Maine, New Hampshire, Vermont and Rhode Island. The decision now goes before the full Federal Energy Regulatory Commission, where the commissioners can reject the decision entirely, approve it or make changes.

BP sues US government over suspension from new federal contracts

British oil giant BP sued the U.S. government on Monday over its decision to bar the company from new federal contracts to supply fuel and other services following the company’s agreement to plead guilty to manslaughter and obstruction charges in connection with the 2010 Gulf of Mexico oil spill disaster.  

 The company said in court papers filed in U.S. District Court in Houston that the Environmental Protection Agency’s decision to suspend the company from such contracts and its continued enforcement of that order is arbitrary, capricious and “an abuse of discretion.”
