There is an exception under Article 10 that allows an existing wind development project that is under SEQR review to remain subject to local siting authority. That remains the case with the BP project, until and if BP withdraws and opts to go with Article 10 instead.
Now that there is a Cape Vincent Planning Board staffed with people of integrity who have no conflicts of interest with a developer, why should the Planning Board seek to terminate its own lead agency status - that it still retains?
good question, TI. Makes you wonder why is the town so anxious to have its zoning law pre-empted by the state siting board?
The current law would only allow maybe seven BP turbines. You can bet the state siting board would like at least 50 -60, maybe more.
that's a lot more revenue for the town!!!
doesn't make a lot of sense to go through all the effort revising the zoning law just to give it up to the state,unless you really don't want the impact of your law to prevail.
