BP Summary of Comments on Preliminary Scoping Statement ~ CVWF proposed land use is not consistent with the Comprehensive Plan


Section 2.4.2 extent and quality of information required (P. 30)

Comment: the statement as to consistency with Ms. inestimable plans required by 16 and NYCRR 1001.4 (e) should provide a detailed an assessment of specific plan components and recommendations. This analysis should identify whether any of the municipal comprehensive plans are specifically referenced in Incorporated into municipal laws or land-use regulations.

Response: the application will include a statement that the town of Cape Vincent has an adopted Comprehensive Plan that is the basis for the Town of Cape Vincent Zoning Law and that the proposed land use is not consistent with the Comprehensive Plan to the extent that the project conflicts with the zoning law.
The application will include an assessment of specific plan components and recommendations. The Application will include a reference to the website where the town of Cape Vincent comprehensive plan is located.

The Town of Cape Vincent successfully updated their Comprehensive Plan and zoning law in 2012 closely following the vision statement in the 2003 Comprehensive plan, to protect the integrity of Cape Vincent’s small town atmosphere, while allowing for compatible residential growth, econ- commercial growth.

BP saying its project is incompatible with the town's comp plan is something the town should bring up at least 50 times a day during hearings. Hammer away. Point out the plan was in place long before BP came to town and long before BP got into the wind business.

This is the single most relevant issue. New York State, with technical assistance from its various counties,encourages and promotes the concept of Comprehensive Planning. This is an integral part of the Municipal Home Rule concept whereby communities engage in self-determination, and responsibly plan for their future.

The substance of a Town's Comprehensive Plan and subsequent Zoning Law, enacted to guide implementation of the long range goals of the Plan are approved and authorized by both the County and the State prior to their adoption.

The ART.X process which authorizes a bureaucratic review board to pre-empt these guidelines,is redundant and over-reaching, in that it not only allows for dismissal of local autonomy, but also renders a significant function of the State government as inadequate and impotent.

The Town of Cape Vincent must hold fast to its declaration that it will not compromise its Zoning Law or Comprehensive Plan.

With its overabundance of procedural rules, timelines, and hollow allowance for public input, ART.X cannot hide from the eventual decision of whether the State will continue to engage its citizens in their own governance, or will it simply dominate them.
